Edo Poll: Again, Appeal Court affirms candidature of Ighodalo
The Abuja Division of the Court of Appeal has affirmed the Candidature of Asue Igodalo as the authentic Governorship candidate of the Peoples Democratic Party for the Edo State Governorship Election.
The panel of Judges of the Court led by Justice Usman Musale, dismissed all the five appeal that have to do with the Primary Election of PDP in Edo State in favour of Asue Igodalo.
Four of the the appeals were against the judgements of the Federal High Court that asked that kelvin Muhammed and his group should be allowed to participate as delegates in the primary election that took place on February 22,2024.
Two of the Appeals were from the PDP and two others from the National Secretary of the Party.
The court in its position reiterated the ever green posture of the law that a delegate has no right of action in respect of primary election of his party.
The fifth judgement was on the appeal filed by one of the aspirants, where he complained about the judgement of the Federal High Court that dismissed his actions against Igodalo as the lawful and authentic PDP Candidate in Edo State.
The court held that the appellant remains a members of the party but has failed to explored the internal mechanism of the party to resolve the matter.
This was in line with the decision of the trial court to the effect that he was an aspirants but failed to exhaust internal mechanism of the party before rushing to court.
The case was adjudge to be premature, that position was reaffirmed by the appeal Court today.
The five appeals from Edo State Gubernatorial primary were resolved in favor of Igodalo, the Governorship Candidate of the PDP
