Court Acquits DCP Abba Kyari On 23-Count Charges
The Federal High Court, sitting in Abuja, presided by Justice James Omotosho, ln Thursday discharged and acquitted Deputy Commissioner of Police, DCP, Abba Kyari, as well as his two brothers, in a 23-count charge instituted by the National Drug Law Enforcement Agency, NDLEA.
Justice Omotosho cleared the suspended DCP Kyari of all the charges on allegations of non-declaration of assets, essentially, landed properties, and other accusations of conspiracy and false affidavits to conceal property origins.
The Judge held that the NDLEA failed to prove the case with sufficient evidence.
Justice Omotosho declared that the prosecution's evidence is "watery." He asserterd that no documents or proof linked Kyari to the disputed properties, including those in Fountain Estate, Kasa (listed under Ramatu Kyari), Linda Chuko Road, Asokoro; and in Maiduguri, Borno State was establsehd by the prosecutor.
He stated that ownership of landed properties can be established through traditional history, title documents, acts of possession, or possession by connection. He maiantained that the prosecution presented none of these.
Kyari argued that properties in Borno were acquired by his late father; and he merely inherited them, together with his siblings.
Meanwhile, other cases are still going on. This judgement is for the asset declaration suit.
